Terms of Service

These terms govern your use of LenderCap (the “Service”). By creating an account, submitting a scenario, listing a lending program, or otherwise using the Service, you agree to them. If you are agreeing on behalf of a company, you confirm you have the authority to bind that company.

We may update these terms. If a change is material we will give notice through the Service or by email before it takes effect, and the “last updated” date above will change. Continuing to use the Service after that is acceptance of the revised terms.

LenderCap is a matching and information platform. We help mortgage brokers and real estate investors find lending programs that fit a scenario, and we help lending companies present those programs. That is the whole of what we do.

• We are not a lender, mortgage broker, or loan originator. We do not originate, fund, service, or broker loans, and we are not a party to any loan.
• We do not provide financial, legal, tax, or investment advice. Match results, scores, and program summaries are informational and are not an offer of credit, a pre-approval, a commitment to lend, or a rate quote.
• Terms come from the lender, not from us. Any loan you obtain is governed solely by the agreement between you and that lender.

Match results are generated from program criteria supplied by lenders and from the scenario details you enter. Criteria change, guidelines have exceptions, and no automated match can account for every underwriting factor. Verify everything directly with the lender before you rely on it.

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for everything done under your account. Tell us promptly at support@lendercap.io if you believe your account has been compromised.

Accounts are for a single named person. Do not share logins, and do not create an account for anyone else without their permission. Some roles — lender company accounts, broker directory listings, verification badges — require review and approval by us, and we may decline or revoke that status.

You agree not to:

• Scrape, crawl, bulk-export, or systematically copy the lender directory, broker directory, program data, or match results, or use them to build a competing database.
• Submit a borrower’s personal information without that person’s knowledge and permission, or submit information you know to be false.
• Upload guideline documents or other content you do not have the right to share, or that contain material you are contractually barred from disclosing.
• Post reviews that are not based on a genuine transaction, review your own company, or otherwise manipulate ratings or placement.
• Probe, scan, or test the security of the Service, attempt to access data that is not yours, or interfere with its normal operation.
• Use the Service to send unsolicited marketing, or for any unlawful purpose.

We may suspend or terminate an account that breaches this section, and we may remove content at our discretion.

If you list a lending company, you are responsible for the accuracy of your programs, rates, criteria, licensing statements, and uploaded guidelines, and for keeping them current. You confirm you hold the licences and registrations required to lend where you say you lend.

You keep ownership of everything you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, and display that content for the purpose of operating and promoting the Service — including extracting structured program criteria from guideline documents you upload, and displaying summaries of them to brokers and investors.

Guideline documents are processed by automated systems, including third-party AI providers, to extract program criteria. Extraction is imperfect and is presented to you for review before it is published. Do not upload documents containing borrower personal information or material you are not permitted to disclose.

A verification badge means we carried out a limited review of the company’s stated details. It is not an endorsement, a guarantee of licensing status, or a warranty about how that company conducts business.

Paid plans are described on our pricing page. Subscriptions renew automatically for the interval you chose until cancelled. Payments are processed by Stripe; we do not receive or store your full card details.

• Cancelling stops the next renewal. Your paid features stay active through the end of the period you have already paid for.
• Fees already paid are non-refundable except where required by law or where we agree otherwise in writing.
• Price changes take effect at your next renewal, and we will give at least 30 days’ notice by email.
• Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled first.

If a payment fails, we may downgrade or suspend access to paid features until it is resolved.

The Service — including its software, matching logic, scoring methodology, design, copy, and the LenderCap name and marks — belongs to us and our licensors. These terms grant you a limited, revocable, non-transferable right to use the Service as intended and nothing more. Feedback you send us may be used freely without obligation to you.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that any match, score, or program detail is accurate, current, or complete.

We do not vet, endorse, or take responsibility for the conduct of any lender, broker, investor, or other user, or for any transaction you enter into with them. Your dealings with other users are between you and them.

To the fullest extent permitted by law, LenderCap and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, lost loans, or lost data, arising out of or relating to your use of the Service — even if we were advised such damages were possible.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$100.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to indemnify and hold LenderCap harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your content, your breach of these terms, or your violation of any law or third-party right — including any claim brought by a borrower whose information you submitted.

You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these terms, if required by law, or if we discontinue the Service. On termination your right to use the Service ends immediately; the sections on submitted content, intellectual property, disclaimers, liability, and indemnity survive. Data handling after closure is described in our Privacy Policy.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and LenderCap agree to the exclusive jurisdiction of the state and federal courts located in Delaware, and each of us waives any objection to venue there. Before filing, please contact us — most disputes are resolved faster that way.
